Leading House Democrat sues Donald Trump under a post-Civil War law for conspiracy to incite US Capitol riot
Mississippi Democratic Rep. The lawsuit, filed by Benny Thompson in his personal capacity, is the first civil action filed against the former president related to the attack on the US Capitol and comes just days after Trump was acquitted by the Senate in his impeachment trial.
If it goes ahead, it would mean that the former president and others would be subject to searches and deposits, potentially exposing details and evidence that were not released during the Senate impeachment trial.
Thompson pointed to Trump’s words and tweets over the months accusing Trump and Giuliani of mobilizing and preparing their supporters for an attack to stop Congress from certifying the 2020 election results on Jan. 6 Led the uprising.
The lawsuit uses federal law passed after the Civil War aimed at countering the violence of the Ku Klux Klan; It allows civil actions to be brought against those who use “force, intimidation, or intimidation” to prevent someone from maintaining the duties of their office.
