Sherwin said in response to a “60 Minutes” question about whether Trump is part of the investigation, whether it was unproven that Trump was a magnet brought people to 6th DC. “We have soccer moms from Ohio who were arrested saying, ‘Well, I did this because my president said I had to get my house back.” He moves the needle towards that direction. Perhaps the president is to blame for those actions. “
Sherwin said other rioters have acknowledged that they moved on from the president’s speech.
Sherwin’s candid remarks as he leaves his Justice Department after a detailed investigation into the Washington, DC prosecutors’ office and violence in the Capitol. He was appointed to the job during the Trump administration. The US Attorney for Acting Attorney, DC Channing Phillips, successor to Attorney General Merrick Garland and Sher Chan, has not directly addressed whether Trump will investigate.
When CBS’s Scott Pelley asked Sherwin if investigators were looking at Trump’s role, Sherwin replied, “We’re seeing people, everything, right. Everything is being watched.”
No public officials have been charged for any of the crimes related to the Capitol riot investigation, and prosecution has yet to focus in bringing criminal cases against the rioters who broke Capitol grounds and members of extremist groups Those against were accused of being co-ordinated before the attack. Many on the defense raised fingers at the former president in court, saying they believed his allegations of election fraud and his response to coming to Washington and marching in the Capitol to oppose congressional certification of election results did.
There is no indication that a formal criminal investigation has been opened against Trump.
The former president, through a spokesman, has denied responsibility.
Sherwin did not respond when asked why treason has not been charged in any of the more than 300 federal criminal cases.
“I personally believe that the evidence is going towards that, and probably matches those elements,” Sherwin said. “I believe the facts support those allegations. And I think that, as we move forward, more facts will support it.”
Some riot defendants already face conspiracy charges approved by a federal grand jury.
While the court will be charged with co-ordination between defendants on conspiracy charges, treason is a more specific criminal law – similar to treason or rebellion – meant to respond to attempts to overthrow the US government. This makes the maximum number of sentences possible than the conspiracy.
